Terms of service

Welcome to Nicoperfect. The terms “we”, “us” and “our” refer to Nicoperfect. Nicoperfect runs this store and website, including all related information, content, features, tools, products and services (the “Services”). Nicoperfect is powered by Shopify, which lets us provide the Services to you.

These terms and conditions, together with any policies they refer to (these “Terms of Service” or “Terms”), set out your rights and responsibilities when you use the Services and buy products from us. Please read them carefully. They include important information about your legal rights, cancellation, returns and our liability.

When you place an order, you agree to be bound by these Terms. Our Privacy Policy explains how we use your personal data. If you do not agree to these Terms, please do not place an order.

Your statutory rights: Nothing in these Terms affects your legal rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other applicable UK consumer protection law. If any part of these Terms conflicts with those rights, your statutory rights prevail.

Section 1 – Who we are and how to contact us

This website is operated by Nicoperfect.

If we need to contact you, we will use the email address, postal address or phone number you gave us with your order.

Section 2 – Access and account

By placing an order, you confirm that you are at least 18 years old and legally able to enter into a binding contract. If you allow minors in your care to use the Services on devices you own or manage, you are responsible for that use.

To use the Services, for example to buy products, we may ask you for information such as your email address and your billing, payment and delivery details. You confirm that this information is correct, current and complete and that you have the right to provide it.

You are responsible for keeping your account login details secure and for activity on your account. You must not transfer, sell, assign or license your account to anyone else. If you think someone has used your account without permission, please contact us straight away.

Section 3 – Our products

We make every effort to show our products accurately. However, colours and appearance may look slightly different on your screen depending on your device and its settings. Images are for illustration only. Your products will match the description we give and will meet your statutory rights described in Section 9.

We may change product descriptions or stop selling a product at any time. A change will not affect orders we have already accepted, unless the law requires it. We may also limit the quantities of a product sold to any person or region.

Section 4 – Orders and how the contract is formed

When you place an order, you are making an offer to buy the products in your basket. We will send you an email confirming that we have received your order. This email does not mean we have accepted it.

Your order is accepted, and a contract between you and us is formed, when we email you to confirm acceptance or to say that your order has been dispatched, whichever comes first. We must receive your payment before we accept your order.

We may decline an order, for example if a product is out of stock, if there is an obvious pricing or description error, or if we cannot verify your payment. If we decline or cannot fulfil your order, we will tell you using the contact details you provided and give you a full refund of any money you have paid.

Please check your order carefully before you submit it. You can still cancel under your statutory cancellation right after we accept your order (see Section 8).

Our products are sold for personal and household use, not for commercial resale.

Section 5 – Prices and payment

All prices on our website are in pounds sterling (GBP) and include VAT at the current rate. Delivery is free (see Section 6), so the price shown at checkout is the full price you pay.

You pay the price shown when you place your order, and this price will appear in your order confirmation email. We may change prices, discounts and promotions from time to time, but changes will not affect orders we have already accepted.

If we notice that a product was clearly and obviously listed at the wrong price, we will contact you before dispatch. You can then confirm the order at the correct price or cancel it for a full refund.

Some promotions may have their own terms, which we will show alongside the promotion. If those terms conflict with these Terms, the promotion terms apply, but they will never reduce your statutory rights.

You can pay with any of the methods shown at checkout. You confirm that the payment details you give are correct, that you are authorised to use the payment method, and that you will keep your account and payment details up to date.

Section 6 – Shipping and delivery

Shipping is free on all orders. We deliver within the United Kingdom.

  • Delivery cost: Free, on all orders.
  • Delivery time: 3–5 business days.
  • Delivery area: United Kingdom.

Delivery times are estimates. We will always deliver within 30 days of accepting your order unless we agree a different date with you. If we do not deliver within the agreed time, or within 30 days, you may be entitled to treat the contract as ended and get a full refund.

We are not responsible for delays caused by events outside our reasonable control (see Section 11). If this happens, we will contact you as soon as possible and do what we can to reduce the delay.

Risk and ownership: The products are our responsibility until they are delivered to you or to a person you have named to receive them. Ownership passes to you once we have received full payment.

Section 7 – Right to cancel (14-day cancellation period)

Under the Consumer Contracts Regulations 2013, you have the right to cancel your contract within 14 days without giving any reason.

The cancellation period ends 14 days after the day you, or a person you have named (other than the carrier), receive the products. If your order contains several products delivered separately, the period ends 14 days after the day you receive the last product.

To cancel, tell us clearly that you have decided to cancel before the cancellation period ends. You can email us at contact@runtheplay.shop or write to us at 1 College Square, CM20 1LP, Harlow, United Kingdom. You may use the model cancellation form below, but you do not have to. You meet the deadline as long as you send your cancellation notice before the 14-day period ends.

Section 8 – Returns and refunds after cancellation

  • Return deadline: Please send the products back to us at 1 College Square, CM20 1LP, Harlow, United Kingdom without undue delay, and no later than 14 days after the day you tell us you are cancelling. You meet the deadline if you send the products back before the 14 days run out.
  • Return costs: Unless the product is faulty or not as described, you pay the direct cost of returning it to us. If the product is faulty or not as described, we pay the return costs.
  • Refund amount: We will refund the price you paid for the products. Delivery is free, so you will not have paid any delivery charge.
  • Refund timing: We will refund you within 14 days of receiving the products back, or of receiving proof that you have sent them, whichever is earlier.
  • Refund method: We will refund you using the payment method you used for the original purchase. You will not be charged any fee for the refund.
  • Condition of products: You may handle the products as you would in a shop to check them. If a product has lost value because you handled it more than that, we may reduce your refund to reflect the loss in value.

Exceptions to the right to cancel

The right to cancel does not apply to:

  • sealed products that are not suitable for return for health protection or hygiene reasons once they have been unsealed after delivery;
  • products made to your specifications or clearly personalised;
  • products that can deteriorate or expire quickly.

For more details, please see our Refund Policy. Our Refund Policy may give you extra rights, but it will never limit your statutory rights.

Section 9 – Your statutory rights for faulty products

Under the Consumer Rights Act 2015, products must be as described, fit for purpose and of satisfactory quality. If a product does not meet these standards, you have the following rights:

  • Up to 30 days after delivery: you can reject the product and get a full refund.
  • After 30 days, or if you choose: you can ask for a repair or replacement. If a repair or replacement is not possible, or does not fix the problem, you can get a price reduction or a refund.
  • Within the first six months: if a fault appears, it is generally assumed to have been there at delivery, unless we can prove otherwise.
  • Up to six years (five years in Scotland): you may be able to claim a remedy if the product was faulty when delivered.

To report a faulty or incorrect product, contact us at contact@runtheplay.shop. We will pay the reasonable cost of returning faulty products. This is only a summary of your key legal rights. For more information, visit Citizens Advice.

Section 10 – Intellectual property

The Services and all their content, including trademarks, brands, text, images, graphics, product reviews, video and audio, and their design, selection and arrangement, belong to Nicoperfect, its affiliates or licensors. They are protected by UK and international copyright, trademark and other intellectual property laws.

You may use the Services for your own personal, non-commercial use only. You must not copy, distribute, modify, publicly display or commercially exploit any part of the Services without our prior written permission, except where the law allows it.

Section 11 – Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, strikes, carrier disruption or failures of public networks. If such an event affects your order, we will contact you as soon as possible. If there is a risk of a substantial delay, you may cancel your order and receive a full refund for any products you have not received.

Section 12 – Our liability to you

If we break these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it would happen, or if both you and we knew it might happen when the contract was made.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.

We only supply products for domestic and private use. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Section 13 – Acceptable use and third-party links

You must not use the Services for any unlawful purpose, to infringe anyone’s rights, to upload malicious code, or to interfere with the security or operation of the Services.

Our website may contain links to third-party websites. We do not control those websites and are not responsible for their content or practices.

Section 14 – Your personal data

We process your personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy explains what data we collect, why we collect it, how long we keep it and your rights, including your right to access, correct or delete your data. You can also complain to the Information Commissioner’s Office (ICO).

Section 15 – Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one shown on our website when you placed it. Changes will not affect orders we have already accepted.

Section 16 – Other important terms

If a court finds any part of these Terms invalid, the rest will stay in force. If we do not enforce our rights straight away, we can still enforce them later. You may not transfer your rights under these Terms to anyone else without our consent. These Terms do not give anyone else any rights to enforce them.

Section 17 – Governing law and disputes

These Terms are governed by the law of England and Wales. You can bring legal proceedings about the products in the courts of England and Wales. If you live in Scotland, you can bring proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring proceedings in either the Northern Irish or the English courts.

If you have a complaint, please contact us first at contact@runtheplay.shop or at 1 College Square, CM20 1LP, Harlow, United Kingdom. We will try to resolve it quickly and fairly.
